Fenner Dunlop Americas, LLC (“Company,” “we,” or “us”) values your (“Authorized User,” “you,” or “your”) privacy.  This Privacy Policy (“Policy”) describes how we collect, use, and share the information that you provide to us when you use the Fenner Dunlop Mobile Application (the “App”).

Please be advised that this Policy does not address our information collection and data practices with respect to our websites and other applications, which are governed by separate policies.

We encourage you to carefully review this Policy to understand our policies and practices regarding your information and how we handle that information.  If you do not agree without our Policy, you shall not download, install, or use the App.  By downloading, installing, or using the App, you agree to be legally bound by the terms and conditions in this Policy.

What Information Does Fenner Collect Through the Fenner Dunlop App?

In connection with your use of the App, we will request the following information from you:

  • Email address;
  • Title or job role; and
  • Employer name

We will also collect information on the searches you conduct within the App (“Search Details”).

How Does Fenner Use the Information It Collects Through the Fenner Dunlop App?

We will use your email address, title or job role, and employer information so we can tailor the right conveyor belt information and recommendations for your specific need. With your affirmative consent, we will use your email address, title or job role, and employer information for purposes of having one of our sales representatives contact you to inquire if we may be able to assist you or your employer with one of Fenner’s products.

We use your Search Details for purposes of providing you with recommendations within the App regarding content or information that may be of interest to you.  We also use aggregated Search Details to understand what content, features, and functions of the App are most popular and in connection with planning new or improved content, features and functions for the App.

Does Fenner Share Information with Third Parties? 

In order to provide the App and its features to you, Fenner utilizes a number of third party service providers, including web and data hosting, software, and technology service providers.  We only permit these service providers access to your information to the extent that such information is required in order for that service provider to render their services to Fenner.  We will also provide your information to third party in the following instances:

Compliance with Legal Obligations

We reserve the right to disclose information that we have collected from you when we are required to do so under a legal obligation, including in response to a court order, subpoena, or other request from an administrative, judicial or governmental authority.  We will disclose information that we have collected about you where such disclosure is required in order for Fenner to protect Fenner’s rights, property, or the safety of our company, customers, or other third parties.

Sale of our Business

If we sell, or substantially all our assets are sold, to a third party or Fenner is reorganized or merged into another entity, the information that we have collected from you, will be among one of the assets that is transferred in connection with the transaction to the acquiring or merging entity.

Children Under the Age of 13

To use our App, you must be at least eighteen (18) years of age.  We do not knowingly market to or solicit personal information from children under the age of eighteen (18).  If you are not at least eighteen (18) years old, please do not provide us with any personal information.  For purposes of this section, the term “personal information” has the same meaning assigned to the term under the United States Children’s Online Privacy Protection Act, which is set forth in Section 6501, et. al. of Title 15 of the United States Code, and its regulations.  If you are the parent or legal guardian of a child under the age of eighteen (18) and believe that your child may have provided us with personal information, please contact us using one of the contact methods provided at the bottom of this Policy so that we can delete your child’s information.

Your Options Regarding Your Information

If you would like to review, correct, update, or delete any of the information that you have provided to us, including your email address, title or job position, or employer name, please contact us using one of the methods included under the section titled “Contact Us” and be sure to indicate in your message that you are making a “Data Request.”  Be sure to include your email address in any such inquiry so that we may locate your information to fulfill your request.

Changes to Our Privacy Policy

Fenner reserves the right to make revisions to this Policy in our sole discretion.  If we make any revisions to this Policy, we will update the Last Modified Date, which is located at the very top of this Policy.  In the event that we make a material change to the way in which we collect, use, or share information, we will provide notice within the App, directing your attention to the revised Policy.  Except as otherwise required by applicable law, any revisions to this Policy will become effective as of the date of posting.  It is your responsibility to regularly check this Policy for any revisions as any such revisions are binding upon you.  Your use of the App following any revisions to this Policy shall constitute your acceptance of such revisions.  If you disagree with any revision to this Policy, you must immediately cease your use of the App and delete it from your mobile device.

California Privacy Rights

If you are a California resident, you may have additional rights under California law regarding our use of your personal information as detailed in this Section, including under the California Consumer Privacy Act of 2020 (“CCPA”).

We do not sell or share your personal information with any third parties for direct marketing purposes.

Categories of Personal Information Disclosed for a Business Purposes

Over the preceding twelve (12) month period, Fenner has disclosed identifiers, commercial information, and profession and employment related information with our third party service providers as set forth in the foregoing sections of the Privacy Policy and in connection with making the App available to you.

Data Rights under the CCPA

California consumers have the right to request that a business, which collects personal information about the consumer, disclose certain information, including:

  • Categories of personal information that the business has collected;
  • Categories of sources the business has collected personal information from;
  • The business or commercial purpose for collecting or selling the personal information (if applicable);
  • Categories of third parties that the business shares personal information with;
  • The business or commercial purpose for collecting or selling personal information; and
  • The specific pieces of personal information that the business has collected about the consumer.

Notice of Right to Opt-Out of the Sale of Personal Information

Fenner does not sell your personal information.

Right To Delete Your Personal Information

The CCPA affords a California consumer the right to request deletion of the consumer’s personal information that has been collected and is maintained by the business.  You may submit a deletion request to Fenner in one of two ways: (1) by calling us toll-free at 800-661-2358 and informing the customer service representative that you would like to have your personal information deleted, or (2) by clicking to contact us through the App and providing us with an indication that you would like to have your personal information deleted.  Once your request is received by us, we will provide a confirmation email that will prompt you to take an affirmative action to confirm the authenticity of your request.

Non-Discrimination Rights

The CCPA specifically prohibits a business from engaging in any discrimination against any California consumer, who chooses to exercise their privacy rights as detailed in this Policy.  If you have any questions about your data rights, you may contact us using the details provided below under the heading “Contact Us.”

European Union General Data Protection Regulation (“GDPR”) Disclosures

Pursuant to the European Union’s (“EU”) GDPR privacy legislation, Fenner is required to provide data subjects with certain disclosures concerning their data rights.  When we refer to “controller,” “data subject,” “personal data,” “processor,” and “supervisory authority” in this section, these terms shall have the meanings set forth in Regulation (EU) 2016/679 of the European Parliament and of European Council, dated 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

The personal data that we collect from you, such as your email address, job title or role, and employer name, is processed on the legal basis of your consent and our legitimate interests in conducting our business and offering the App to our customers and prospective customers.

Recipients of your Personal Data

We provide your personal data to third parties as set forth in this Privacy Policy, including our third party service providers. Data Transfers

Fenner is located in the State of Pennsylvania, U.S.A.  When you provide us with personal data through the App, this information is collected and stored within the United States.  We have no intention of transferring your personal data outside of the United States, but in the event that a transfer of your personal data is required, we will comply with all applicable data privacy laws, including the GDPR and will utilize an approved mechanism for transfer, including the then-current Standard Contractual Clauses, as approved by the EU Commission, as applicable.

Data Retention Policy

We retain your personal data until you contact us to request deletion of such information.

EU Data Rights

In accordance with the GDPR, data subjects located within the EU have been granted certain data rights, including the right to request that a data controller provide access to and rectification of the personal data that the data controller has collected and maintained about the data subject.  As a data subject, you are also afforded the right to request deletion of your personal data that the data collector maintains about you.  Data subjects are also afforded the right to object or block certain processing activities.  Data subjects have a right of data portability with respect to the personal data that the data controller maintains about the data subject.  If our legal basis for processing your personal data is based solely on the data subject’s consent, the data subject maintains the right to withdraw such consent at any time.  Where we fall short of our legal requirements for your data rights, data subjects have a right to lodge a complaint against us with a supervisory authority.

Statutory or Contractual Requirement for the Collection of Personal Data

The personal data that we collect from you in connection with your use of the App is not required by statute or applicable law.  Our App requests your email, title or job role, and employer name so that we may contact you if you authorize us to do so.  If you do not provide us with all of the requested information, we will not be able to contact you.
